Terms and Conditions:

Please read the following terms and conditions carefully.

By accessing the Market Analysis Tools and Databases (hereafter “tools”) of the International Trade Centre (hereafter “ITC”) listed below, users are agreeing to be bound by the following terms and conditions. By accessing and using the tools, users agree to periodically review these terms and conditions and to be conclusively bound by any future modifications as advised on the ITC portal: https://marketanalysis.intracen.org.

General

  1. The tools can either be accessed directly or through the Market Analysis Tools portal https://marketanalysis.intracen.org (hereafter “portal”). The portal and tools are hosted on ITC’s server in Geneva. ITC holds the copyright to the portal’s and the tools’ web sites.
  2. Access to the portal and tools is granted to users and partner organisations in any country on a non-exclusive basis.
  3. Access to the portal and tools (except Export Potential Map) is by way of a username/password. ITC or a National/Institutional+ License holder provides the user ID (username) and password. Access is free of charge to users in developing countries (see Condition 4) from 1 January 2008 until further notice. For users in developed countries, some parts of the tools are freely accessible. However, if users in developed countries wish to gain full access to the tools, a subscription is required as indicated in the ITC's tools subscription options and fees page https://mas-admintools.intracen.org/Accounts/OptionsFees.aspx (*)
  4. The list of developing countries is based on ITC's activities and country programs. All countries and territories are included except members of the European Union (EU) and of the Organisation for Economic Co-operation and Development (OECD). However, OECD members as, Mexico, Turkey, Republic of Korea and Chile, where ITC is still active with country programs, are considered as developing countries.
  5. ITC reserves the discretionary right to grant temporary access to the portal and tools free of charge to selected users without justification or prejudice to the future implementation of ITC’s official tools subscription options and fees for these selected users.
  6. Users are responsible for any use of their account under their user ID (username) or password by any person or entity. Users are further responsible for ensuring that any use of their account complies fully with the provisions of these terms and conditions. Users are responsible for protecting the confidentiality of their user ID and their password.
  7. ITC reserves the right to revoke a user’s access to the portal and tools in the event of non-compliance with these terms and conditions.
  8. Except in circumstances outside its control, ITC is responsible for ensuring the effective and timely access by users to the portal and tools. The Helpdesk will operate and maintain the websites and tools during Swiss working hours, unless otherwise agreed.
  9. The user acknowledges that, ITC is not responsible for any trade policy position developed using the portal and tools.
  10. ITC shall have the sole and exclusive right, at any time to alter or amend these terms and conditions or to otherwise change, modify or amend the terms and conditions applicable to use of the tools. ITC shall have the sole and exclusive right to change or discontinue any aspect or feature of the tools, including but not limited to content, functionality, hours of availability, and hardware or telecommunications equipment, software or services needed for access or use. ITC will provide reasonable notice to users of any changes, modifications or amendments to these terms and conditions via mail or email; however, any use of the tools by users after any such changes, modifications, or additions shall be governed by these terms and conditions.
  11. Users are solely responsible for obtaining, maintaining and all costs associated with any telephone, computer hardware and software, modems, telecommunications connections, and/or other equipment and/or services which are or may be needed for access to and use of the tools.
  12. Users expressly acknowledge and agree that any and all use of tools is at their sole risk. Neither ITC nor any of their respective employees, agents, third-party content providers, or licensors warrant that access to and use of the tools will be free from interruptions or free from errors; nor do they make any warranty as to the results that may be obtained from use of the tools, or as to the accuracy, reliability, or content of any information or service provided through the tools.
  13. Users further expressly acknowledge and agree that information, text, graphics, and hyperlinks provided to users through the tools and located on other sites throughout the combined global electronic networks known as the Internet and the world-wide-web are provided solely as a resource and a convenience to users. Such hyperlinks to other sites are not an endorsement by the ITC of those sites. ITC makes no warranty, either express or implied, as to the accuracy, reliability, or content of such information, text, graphics, and hyperlinks. ITC has not tested any software located on other sites and does not make any representations as to the quality, safety, reliability or suitability of such software. The tools are provided "as is" without any warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose.
  14. In no event shall ITC be liable to users or any other person for any loss of business or profits, or for any indirect, incidental or consequential damages arising out of any use of, or inability to use ,the tools, even if ITC was previously advised of the possibility of such damages, or for any other claim by users or any other person.
  15. Users acknowledge and agree that the delivery system used for the tools, i.e., the Internet and the world wide web, are unpredictable and may, from time to time, impede access to the tools. Users acknowledge and agree that ITC is in no way responsible to users in any way whatsoever for any interference with the use of or access to the tools and users expressly waive and forever discharge and release any and all claims against ITC in connection therewith.
  16. ITC may terminate these terms and conditions at any time by providing reasonable prior notice to users. Without derogating from or otherwise limiting the foregoing, ITC shall have the right to immediately terminate these terms and conditions and/or users rights to use the tools in the event of any breach by users of these terms and conditions.
  17. Any dispute, controversy or claim arising under or pursuant to these terms and conditions shall be settled by an agreed mode of dispute resolution, including but not limited to arbitration, which shall be the exclusive mode of resolving disputes hereunder. Nothing contained in or related to these terms and conditions shall be deemed a waiver, express or implied, of the privileges and immunities of ITC. ITC is a joint subsidiary organ of the World Trade Organization and the United Nations and enjoys Privileges and Immunities by the Convention on Privileges and Immunities of the United Nations of 13 February 1946.
  18. All users are authorised to consult and download (within specified limits, and only when a download button is available) data and analysis from the portal and tools for their own non-commercial usage. Usage of any kind of robots or automated solutions with the purpose of bulk extraction of data and analysis available in the portal or tools is strictly forbidden. Unless with the prior written authorization from the ITC, users acknowledge and agree that they must not: resell or redistribute the data. The source of the data must be acknowledged and cited in the following way: "the tool’s NAME (please consult the list above), International Trade Centre, the tool's URL (please consult the list above)".

Institutional License

  1. To access the full version of the portal and tools, users from developed countries may purchase an Institutional License that provides access to the generic, non-customised version of the portal. This type of subscription is for users who do not wish to disseminate access to the portal and tools to third parties outside the organisation or institution.
  2. The holder of an Institutional License is provided by ITC with a user ID (username) and password to access the portal and tools. An Institutional License subscription only provides access to the portal and tools for the subscribing Institution License holder. User IDs (usernames) and passwords are confidential and should not be published, disseminated or shared with any third party, but can be distributed or shared within the subscribing organisation or institution. In order to simplify access to the portal or tools within an organisation holding an institutional license, the holder of an institutional licence can choose the institutional user management option where all users with the same email extension (e.g. @intracen.org) can individually register themselves to access the portal or tools with their own user ID (username) (e.g. marysmith@intracen.org or johnbrown@intracen.org) and password and still face the same terms and conditions as defined for the institution.
  3. ITC reserves the right to change the User ID (username) and password of an Institutional License holder from time to time with one (1) month’s notice in writing by email, mail or fax.
  4. The holder of an Institutional License is authorised to use freely any data and analysis extracted from the portal and tools. However, in all cases the source of the data must be acknowledged and cited in the following way: "the tool’s NAME (please consult the list above), International Trade Centre, the tool's URL (please consult the list above)".

National License and Institutional+ License

  1. Users in developed countries may purchase a National License/Institutional+ License To do this, National License/Institutional+ License holders will sign a Memorandum of Understanding (MOU) with ITC that sets out conditions of access and the subscription fee.
  2. Holders of a National License/Institutional+ License may disseminate access to the portal and tools to third parties within the country in question (National License) or to their business partners (Institutional+ License).
  3. The holder of a National License/Institutional+ License is provided with a confidential, primary user ID (username) and password. The holder of a National License/Institutional+ License is not authorised to publish, disseminate, sell or share its primary user ID (username) and password with any third party other than those specified in the MOU between ITC and the National License/Institutional+ License holder.
  4. The holder of a National License/Institutional+ License is authorised to disseminate access to the portal or tools to third parties in its own country (National License) or to specified number of users (Institutional+ License). Access by third parties is only authorised with a different, secondary user ID (username) and password obtained from the National License/Institutional+ License holder or ITC via a registration web page.
  5. ITC reserves the right to change the user ID (username) and password of a National License/Institutional+ holder or any third party from time to time with one (1) month’s notice in writing, by email, mail or fax.
  6. The source of the data must be acknowledged and cited in the following way: "the tool’s NAME (please consult the list above), International Trade Centre, the tool's URL (please consult the list above)".
